PIPL – PRC

Under PRC law, if you are a resident of the PRC, we will primarily rely on your consent to process your personal information, provided that where any of the lawful basis exists, we will process your personal information based on that applicable lawful basis.
We will obtain your consent before processing your personal information, except:

  • where it is necessary for the conclusion or performance of a contract or for the implementation of human resources management;

  • where it is necessary for the response to a public health emergency or for the protection of your life, health and property safety;

In addition, we will also obtain your separate consent before processing your sensitive personal information, transmitting your personal information out of the PRC, or sharing your personal information to other personal data processors (i.e., “controller” under GDPR, same below in all “PIPL – PRC” sections).

3. HOW AND WHEN WE SHARE YOUR PERSONAL DATA

We do not share, sell, exchange or rent your personal data to unrelated third parties for marketing purposes. We may share your personal data with third parties in the following cases:

  • Service providers and business partners: We may share your personal data with our service providers and business partners who provide us with marketing services and other business operations for the purposes set out above. For example, we may partner with companies to process secure payments, fulfill orders, optimize services, provide online behavioural advertising, send newsletters and marketing messages, support email and messaging services, and analyze information. PIPL – PRC

If you are a PRC resident, PIPL distinguishes our sharing of your personal information with a data processor and our sharing of your personal information with a contractor. Under the PIPL, a data processor determines the purpose and means of processing, whereas a contractor may only process personal information pursuant to the data processor’s instructions. Where your personal information is shared with another data processor, we will inform you of the identity and contact information of the data processor, as well as the purpose and means of processing and the types of personal information shared, and obtain your separate consent. Unless we notify you otherwise, any sharing of your personal information pursuant to this Section 3 is of a processor-to-contractor nature.
